Despite the problems, failures and malfunctions, the Ministry of Labor is proceeding with the implementation of the digital work card – with small time deviations – but with the goal of its full implementation by the end of 2024.
Industry and retail will have three – extra – months to adjust, as full implementation is moved to July, instead of April 1, while the measure’s piloting will continue in the interim.
At the same time, the Ministry of Labor is planning micro-interventions in the implementation of the card, so that the use of the digital work card is more efficient and easier, both for employees and businesses.
When the recording of the problems and malfunctions in the sectors where it is currently piloted (industry and retail trade) will be completed, then instructions will be given to solve these problems. The interventions will not alter the essence of the measure, but will improve its implementation. One of the interventions being considered is the existence of a small, flexible time limit, within which the employee will be able to punch his card, without changing his working hours. This limit cannot be more than 15 to 20 minutes, before and after the end of the schedule.
The 9 violations
Indicative are the cases of circumvention of the measure, which were collected by the Federation of Associations of Employees in Services and Commerce:
· Employees who work on behalf of third parties (shop in a shop) in cosmetic stores, shopping malls, spas, beauty centers, perfume shops, etc., do not use a digital work card, as their employers do not provide them with the required tablets with the relevant application.
· Companies of super markets, logistics, department stores, do not provide the possibility of applying the digital card to the staff of contractors they employ in the warehouses alongside their own staff, with the specialties of the “picker” preparing orders and the unloader.
· Employees who get to work at 5 a.m. have been instructed to punch their card at 6am. This is done so that the one hour of night work, which is paid differently, does not appear in the “Ergani” system.
· Security companies that undertake contracts for 24-hour – seven-day a week guarding of facilities and buildings of the State and its bodies, continue to implement 12-hour employment of the guards, with the employees’ digital card being permanently “stamped” for 8-hour shifts on weekdays and not on Sundays and holidays and always on day shift.
· Cleaning companies that undertake cleaning contracts in large buildings, of private companies as well as of the State and its agencies, with main employment during the night hours when the facilities are not working, display their staff’s digital cards “stamped” only in day shifts.
· Hourly workers are reminded that they must not forget to punch in their card at 4:00 p.m., despite the fact that they continue working until 8:00 p.m.
· Online order clerks have been instructed to punch their card, regardless of whether they have finished their order or not, and continue working as normal.
· Drivers have been asked not to tap a card at all, since they are outside the store.
· Store managers have asked workers to print the QR CODE from their digital work cards for them, telling them that the managers themselves undertake this “obligation” of punching the card
Retail
Since last October and the passing of the labor law, businesses that have joined the electronic working time measurement system using the digital work card have been given the option not to register changes in working hours and overtime work before the start of implementation their. This, according to retail workers, is the biggest problem when it comes to recording overtime, since it is practically not recorded in real time.
