The planning of the Ministry of Labor and Social Security for the extension of the Digital Labor Card to all sectors of professional activity by 2024 is progressing rapidly.
According to the planning of the ministry, in the next period of time, it is planned to extend the application of the measure to the businesses of the tourism sector and catering, following exactly the same procedure as the rest of the sectors of the economy.
Also, from January 1, 2024, businesses whose main activity belongs to the industry sector, as well as businesses whose main activity belongs to the retail trade sector, must have joined the Digital Work Card system.
In this context, productive bodies, trade associations and chambers, hold informational events, so that the new procedures can be understood, which concern both companies and their accounts and employees.
For the sectors that have compulsorily joined the Digital Work Card system since January 1, 2024 (industry and retail), a fine will be imposed on any business that violates the current institutional framework from the following dates: From April 1, 2024 for businesses belonging to industry sector, from 2 May 2024 for retail businesses and from 13 May 2024 for both sectors with a number of employees not exceeding 10.
It is noted that, in the event of a discrepancy between the actual employment and the relevant marking on the card, a fine of 10,500 euros per employee is imposed on the employer, whose Digital Card cannot be matched as above.
As the Minister of Labor and Social Security, Domna Michailidou, states in her public statements, its universal application has multiple benefits for the labor market, as the rights of workers are guaranteed, healthy competition is strengthened and the sustainability of the insurance system is ensured.
After all, the Digital Work Card was instituted by article 74 of Law 4808/2021 on Labor Protection, with the aim of ensuring the working hours of employees, the legal use of overtime, as well as the daily and immediate – in real time – notification to the “ERGANI” Information System of the start and end of work for each employee.
At the same time, Mrs. Michailidou has made it clear that she is in constant dialogue with the business community, in order to resolve all the problems that may arise during the implementation of the measure.
Applied
Until now, the scope of the Digital Job Card system includes the following seven categories of businesses:
- All the country’s banks from 01/07/2022.
- Supermarkets, with more than 250 employees, with main Activity Code (CAID) 4711, from 01/07/2022.
- The security companies, with main KAD 801 and 802, from 16/02/2023.
- The private insurance companies, with main KAD 651, from 16/02/2023
- The following organizations: OSE SA, ERGOSE, Fixed Communications SA, OSY, OASA, OSETH, OASTH, Attiko Metro, Building Infrastructures SA, Egnatia Odos SA, EYDAP and ELTA, as well as Hellenic Train and the Hellenic Railway Equipment Maintenance Company, from 22/03/2023.
- Businesses belonging to the industry sector, with a main KAD from 10 to 33, except for 19, from 01/01/2024.
- Businesses that belong to the retail trade sector, with main KAD 47, from 01/01/2024.
When the main employer ID card in TAXIS is one of those mentioned in the above seven categories, the business-employers are included in the Digital Work Card system for all their employees, including their branches.
