In total, the Dijon academy has three referents per department, Côte-d’Or, Saône-et-Loire, Nièvre and Yonne, present to help families and schools in the management of these situations. Added to this is the implementation since September 2021 in establishments in Bourgogne du school anti-bullying program (pHARe).

The plan provides for example training with the reinforcement of digital in teaching, the appointment of student ambassadors in each school, college and high school and workshops where parents are involved.

At the start of the 2022 academic year, all colleges and schools will have to register. The idea is to identify situations of school bullying as early and as closely as possible.

In parallel, interventions carried out by gendarmes are also organized. “It’s complementary because there are very serious situations. So having the word of the police can be interesting. Harassment is an offence, it’s punishable by law. There can be penalties even when you’re young, so it’s important to have that look”.

Online harassment is indeed judged by the criminal court. If the perpetrator is a minor, the penalties vary according to his age. His parents, as civil servants, must in particular compensate the parents of the victim.

  • If the harasser is a minor and over 13 years old, he faces one year in prison and a fine of 7,500 euros if the victim is over 15 years old.
  • If the harasser is a minor and over the age of 13, he faces 18 months in prison and a fine of 7,500 euros if the victim is under 15.

But it is remembered difficult to punish the culprits because the victims must collect themselves the proofs of the facts which they underwent. Filing a complaint can also be seen as a provocation by the harassers, thus provoking a new wave of online violence.

In Burgundy, the gendarmes who have noticed an increase in the number of interventions due to cyberbullying for almost 4 years. “There are social networks that are used earlier and earlier and often without adult control. Now, is there more harassment than before? I don’t think so, but we talk about it more and more”, said Major Christophe Gabriot, commander of the family protection house in Yonne.

Anyone who is the victim of harassment on social networks can report the facts on the site PHAROS, managed by specialized police and gendarmes. The 3818 is also a telephone platform available to free speech.
