Investors in direct investments can register their claims with the insolvency administrator by June 15, 2022. The creditors’ meetings are scheduled for July 13, 2022.
Investors can absorb at least part of their financial losses via a possible insolvency ratio. However, since only registered claims can be considered in the insolvency proceedings, investors should register their claims in good time. The creditors should also state which security interests they are asserting. If you miss the deadline, you can still register your claims, but you will have to pay a fee.
It is not yet possible to say how high a possible insolvency rate will be. “However, investors must reckon with the fact that it will not be sufficient to fully meet their demands,” says attorney Marcel Seifert, BRÜLLMANN Rechtsanwälte. In order to protect oneself against financial losses, claims for damages can also be asserted independently of the insolvency proceedings.
Claims for damages may have arisen, for example, against the investment advisor or investment broker. One of their duties is to properly inform investors about the existing risks of an investment. They must also check the investment model for plausibility. “If these information obligations were neglected, claims for damages against the investment advisors and brokers may have arisen,” said Mr. Seifert.
