“Democratic Party Chairman AHY Claims Continued Harassment by Moeldoko Amid PK Review Attempt”

TEMPO.CO, Jakarta – Democratic Party general chairman Agus Harimurti Yudhoyono (AHY) has returned to responding to the case of the Extraordinary Congress or KLB alias Democratic Party coup by President Moeldoko’s Chief of Staff, which is currently being attempted through a Review alias PK. To this day, AHY thinks the Democrats are still being harassed by Moeldoko.

“Pak Airlangga’s friend is there,” AHY said while releasing to the general chairman of the Golkar Party Airlangga Hartarto, when the two of them gave a press conference after meeting former President Susilo Bambang Yudhoyono (SBY) in Cikeas, Bogor, West Java, Saturday, April 29 2023. AHY seemed to smile faintly while Airlangga only reacted calmly in response.

Previously, AHY had said that Moeldoko and the former Secretary General of the Democrats according to KLB Jhonny Allen Marbun had acknowledged the Judicial Review or PK on the Supreme Court decision which won the Democratic Party led by AHY.

“After the fake KLB which was illegal and failed miserably, this time they filed a PK at the MK. This PK is the last attempt to test the Supreme Court’s cassation decision,” AHY said in a press conference at the Democratic DPP Office, Jakarta, Monday, April 3, 2023.

AHY said that the cassation had rejected Moeldoko’s lawsuit through decision number 487/K/TUN 2022 on September 29, 2022. But now, said AHY, Moeldoko claims to have found 4 novums, alias new evidence.

However, AHY denied that the novum submitted by Moeldoko was new evidence. This is because the four of them have become evidence at the Jakarta Administrative Court trial with case number 150/G/2021 on November 23, 2021

Due to Moeldoko’s actions, AHY officially sent a legal team to submit a counter memorandum of answers to PK Moeldoko to the Jakarta Administrative Court. “We believe the Democrats are in the right position,” said AHY.

Previously, the Supreme Court had rejected Moeldoko’s cassation in the case of the Democrat Party Extraordinary Congress in Deli Serdang some time ago. “Reject the cassation,” said the Supreme Court’s decision on the institution’s official website in Jakarta, Monday, October 3, 2022.

The case filed by Moeldoko was registered under number 487/K/TUN/2022 with the respondent being the Minister of Law and Human Rights and General Chair of the Democratic Party Agus Harimurti Yudhoyono or AHY.

The case was decided by a panel of judges chaired by Irfan Fachruddin with members Yodi Martono Wahyunadi and Sudaryono and Substitute Registrar Joko Agus Sugianto.

In response to the Supreme Court decision, the Secretary General of the Democratic Party, Teuku Riefky Harsya, appreciated the Supreme Court and the panel of judges who examined the case fairly and in accordance with the law.

He said that the rejection of these two cassation decisions further emphasized that the leadership of the General Chairperson of AHY and the AD/ART results from the 2020 Democratic Party Congress were legal and in accordance with the rules.

“The Democratic Party is grateful and appreciates the Supreme Court and the panel of judges who have examined this case fairly,” he said.

The chaos between Moeldoko and the Democratic Party started when the former TNI Commander was declared elected as General Chair of the Democratic Party at an Extraordinary Congress held in Deli Serdang, North Sumatra in early 2021.

In 2021, the Democratic Party will be hit by internal issues. Some of the party’s cadres held an Extraordinary Congress or KLB, and appointed Moeldoko as General Chair. KLB Democrats were carried out because some of these cadres were dismissed and accused of involvement in the coup. The purpose of the takeover is said to be in the interest of the 2024 presidential candidate.

AHY immediately announced that Moeldoko had attempted a party coup. Both sides also submitted this dispute to legal channels.

In Cikeas, AHY reiterated that Democrats had won 16 times in cases related to this outbreak. Apart from that, the Democrat legal team also believes that there is not the slightest loophole legally to win PK Moeldoko. “Why? because there is no new novum,” he said.

According to AHY, this case is not only the Democrats’ bet, but also related to efforts to maintain democracy. In front of Airlangga, AHY was also grateful. “Pak Airlangga provided moral support from the start. At that time, I clearly remember him saying, wow, things like this shouldn’t actually happen in our country, but they have happened and are still happening,” he said.

AHY also prayed that Golkar and Democrats and any other party would no longer receive intervention and have their sovereignty seized by the hands of power. “Both politically, legally, and also socially,” said AHY.
