The lawyers in charge of the defense of Derek Rosa, the Cuban boy who murdered his mother in Hialeah last October 2023, have requested that his trial, which was scheduled for this weekwas late.
The request was made during the last court hearing by Judge Richard Hersch, which the minor attended. According to Roda’s defense, his lawyers do not believe they are ready to begin the process, so they requested a little more time to prepare.
Additionally, the young man’s lawyers assured that the state prosecutor’s office has not provided sufficient evidence to accept the start of the trial in the coming days, since they still require witness reports and images from a security camera to plan the defense in favor of Pink.
According to the media Telemundo 51the young man, only 13 years old, remains detained in an area adapted for minors in the Metrowest adult jail.
On the other hand, prosecutors assured that they are ready to begin the trial, where, if found guilty, the young man could receive life imprisonment or even the death penalty for the crime of first-degree murder.
The judge in charge of the case set the next hearing for Tuesday, February 20, to give the minor’s defense the opportunity to prepare to present a better case. After this decision, Rosa’s lawyers avoided the press so as not to comment.
The aforementioned media consulted the criminal lawyer Alberto Quirantes, who considers that the defense of the Cuban child could request a court order that forces the prosecution to hand over the missing evidence, if not, this evidence would be excluded from the rest of the evidence.

The case was registered on October 12, 2023 in the city of Hialeah, in Miami-Dade County, where the minor called the police to confess that he had fatally stabbed his mother, Irina García, while she was sleeping.
During the disturbing callthe minor confessed that he planned to kill himself with a gun belonging to his stepfather, but he did not have the courage to pull the trigger.
The officers arrived at the scene and found García’s body inside his room, next to the crib where Rosa’s sister was sleeping. The baby, only 15 days old, was found without injuries.
In the following interrogations, the minor confessed that he had planned everything in advance, conducting searches on the Internet to find out which parts of the body were most susceptible to an attack with knives. Likewise, Rosa claimed to have taken photographs of the body, which she shared with some acquaintances on her social networks.
