Decision reserved on Bushra Bibi’s transfer request to Adiala Jail

Web Desk: The Islamabad High Court has reserved its decision on the request to transfer PTI founder Imran Khan’s wife Bushra Bibi from Bani Gala to Adiala Jail.
Justice Mian Gul Hasan Aurangzeb heard the request of Bushra Bibi’s transfer from Bani Gala Sub Jail to Adiala Jail.
The court asked when Bushra Bibi was punished in which case? On which Bushra Bibi’s lawyer Usman Riaz Gul said that the punishment was given in Tosha Khana and Idt marriage cases, in Toshah Khana on January 31 and in Idt Nikah case on February 3.
The lawyer said that in both the cases, the trial was conducted illegally, and after the conviction, a warrant of arrest is issued, which goes to the superintendent of jail.
Bushra Bibi was not in the court at the time of sentencing, she surrendered herself, on the order of the Chief Commissioner, Bani Gala was declared a sub-jail and Bushra Bibi was transferred there, the sub-jail order was issued by the Chief Commissioner’s Office. And at the same time the transfer took place, under the Prisons Act the house of Bani Gala was given the status of a sub-jail.
Justice Mian Gul Hasan Aurangzeb told Bushra Bibi’s lawyer to read the jail rules and what they say.
The lawyer said that Bushra Bibi went to Adiala Jail on the order of the trial court which was sent to the Superintendent Jail, later the Chief Commissioner issued an illegal transfer notification on the orders of the Ministry of Home Affairs.
The petitioner’s lawyer further stated that there was no directive from the authorities regarding the transfer of Adiala Jail to Bani Gala Sub Jail, the notification of the Chief Commissioner was not an instruction to the concerned authorities i.e. the Superintendent of Adiala Jail, nor was any directive issued by the Provincial Government. G Jail issued any directive, Chief Commissioner’s notification of transfer of Bani Gala Sub Jail is illegal.
The court asked what is the process of transfer from one province to another province? Bushra Bibi’s lawyer Usman Riaz Gul said that the place of imprisonment should have been determined by the trial court and not by the Chief Commissioner, Bushra Bibi’s imprisonment was ordered. The letter was from Adiala Jail, Chief Commissioner’s notification of transfer to Bani Gala Sub Jail should be annulled, with this the arguments of Bushra Bibi’s lawyer Usman Riaz Gul were completed.
When the State Council started arguments, Justice Mian Gul Hasan told them that you are saying that we have done this and will continue to do it in the future. Tell me how many women you admitted to jail after Bushra Bibi? The lawyer said that 141 women were admitted to jail.
The court raised the question that now you tell how the place was made for these women, you cannot present the man in the court that there are security concerns, now you say that there are security concerns in the jail, so he should be transferred home, tell me what is going on. Is?
Later, Islamabad High Court Judge Justice Mian Gul Hasan Aurangzeb reserved the decision on the request of Bushra Bibi after hearing the arguments.
