Former Daycare Worker Sentenced for Child Mistreatment in Amsterdam
Amsterdam, Netherlands – A 38-year-old former daycare worker in Amsterdam’s Nieuw-West neighborhood has been ordered to perform 30 hours of community service for mistreating a child in her care. Although the child escaped physical injury, the court concluded that the actions likely caused pain.
The case came to light in June of last year when the daycare supervisor reported the incident to the police. Surveillance footage revealed the worker aggressively handling a child on two separate occasions in May and June. Police reviewed the footage, along with recordings from twelve other days, but the child, due to their young age, was unable to provide a statement.
"Naar algemene ervaringsregels stelt de rechtbank vast dat het kind door de hiervoor vastgestelde gedragingen pijn is toegebracht," the court’s ruling stated.
The court determined that the worker subjected the girl to inappropriate physical interactions, including pushing, grabbing her face and pulling her forward, and forcefully placing her in a chair. On three occasions, she picked the child up and then "with considerable force" put her back down on a bench.
The court acknowledged the worker’s claims of being deeply affected by the footage and denying the charges of mistreatment. However, she attributed her behavior to a difficult working environment and a personal conflict with her employer, where she had been employed for twelve years.
While acknowledging the personal stress, the court emphasized: "Verdachte had op alle momenten dat het kind aan haar zorg was toevertrouwd moeten zorgen voor een veilige, beschermde en geborgen omgeving voor het kind. Het is kwalijk dat zij dit niet op ieder moment voor ogen heeft gehouden en juist een onveilige situatie voor kind heeft gezorgd door haar op twee dagen meerdere malen te mishandelen."
Ultimately, the court sentenced the worker to 60 hours of community service, with half of the sentence suspended for a two-year probationary period. This decision aligned with the prosecution’s recommendation. The court did not deem emotional regulation therapy necessary, citing a low risk of reoffending, the worker’s acknowledgment of her mistakes, and her proactive steps to seek support from her physician.
The consequences of this incident have been significant for the worker as well. She was immediately dismissed from her position at the daycare. Although later reinstated, she ultimately left the facility through mutual agreement. She currently remains unemployed.
