Civil rights activists sue against tracking

The Deutsche Bahn Navigator app passes on the data collected to third parties. The IT security blog has this “Kuketz Blog” found out. So have “Deutsche Bahn not only has a huge problem with punctuality and reliability, but also a huge problem with data protection.” The civil rights organization Digitalcourage now wants to sue Deutsche Bahn.

The data sent includes information such as the number of travelers, the number of children traveling with you, the day of departure and the start and end point of the trip. It is irrelevant whether the Android or the iOS version of the app is used. Both pass on the same data with minor differences.

In addition to other tracking cookies, the aim of the transfer is also the marketing and advertising platform Adobe Marketing Cloud. There is no possibility of objection here: The cookies used can be reduced to “necessary cookies”. However, Adobe is also listed among these, so it cannot be deactivated.

In an open letter Kuketz, the lawyer Peter Hense and the civil rights organization Digitalcourage asked Deutsche Bahn in April to change its data transmission behavior within two months. According to their assessment, the app violates GDPR and TTDSG (Telemedia Data Protection Act). This is particularly serious because of the “Market-dominant position of Deutsche Bahn, […] because they affect millions of people.”

Deutsche Bahn responded in one Message to Kuketz, in which she objects to a violation of the GDPR. However, the cookie settings were presented to the responsible data protection supervisory authority for evaluation. However, no changes were made by the end of the period set by Kuketz and Co., which is why Digitalcourage now against Deutsche Bahn.
