The visitor’s family sued Disneyland after his mother died of an infection after being treated, after falling at the amusement park.
Insider reported, Friday (20/1/2023) this lawsuit stems from Joanne Aguilar (66) spending 10 days in the hospital after an accident while playing on Jungle Cruise, one of the rides in Disneyland. He died five months later from an infection that resulted in septic shock during his recovery.
The family alleges that Aguilar’s injuries in the park caused his death. His daughters Zenobia Hernandez and Andrea Maullul sued Disneyland and the Walt Disney Company for damages including Aguilar’s burial and funeral expenses, attorneys’ fees, medical expenses and other incidental damages.
In their lawsuit, Maullul and Hernandez said they and their mother visited Disneyland Resort in Anaheim, California, on August 22, 2021. Aguilar injured his knee, which resulted in him obtaining a wheelchair from the park’s disability access service.
However, when Aguilar wanted to go on a Jungle Cruise, he was told by workers that wheelchair accessible boats were not available. Information for travelers, Jungle Cruise rides have disabled access boats that use electronic lifts to load visitors with wheelchairs and scooters.
The officer offered to help Aguilar to help him get into the normal boat. When the ride was over, Aguilar had to get out of the boat and officers placed a block to reduce the height of the steps. The lawsuit stated that the beams were small beams without significant protection.
Aguilar was trying to lift himself on the stairs. And then the Disney cast officers booed and giggled when they saw him. Aguilar was embarrassed by the situation.
As Hernandez and Maullul helped their mother out of the boat, the beam became unstable and Aguilar lost his balance and fell backwards. He also suffered an open fracture in his right leg.
An ambulance then took Aguilar to Anaheim Global Medical Center, where he underwent surgery and was hospitalized for 10 days before being transferred to a rehabilitation center. At the center, he contracted an infection that caused septic shock. He also died on January 29, 2022.
Hernandez and Maullul said in the complaint that their mother had “never been able to come home” since the accident at Disneyland and accused the park and its staff of negligence and breaching disability access and safety standards.
In Disney court filings, Disney’s lawyers said Aguilar’s injuries were caused by another person or entity and that Aguilar and his daughters were aware of the risk they were taking on the theme park. Disneyland.
