Danuta Dmowska-Andrzejuk fictitiously employed? Ruch Totalizatora

Wirtualna Polska writes about Totalizator Sportowy’s notification to the prosecutor’s office. The text of the notification, which was obtained by the editorial office, states that former Minister of Sport Danuta Dmowska-Andrzejuk earned PLN 438,615.8 as an advisor from April 2021 to November 2023, although it can be assumed that during that time she was absent from work for a total of 483 days.

The company provided such information “based on data obtained during the analysis”. “Due to the results of the analysis of employee activity, there is a reasonable suspicion that the conclusion of the employment contract was of a fictitious nature” – it was indicated in the content.

The letter states that Dmowska-Andrzejuk signed a contract that did not specify the scope of the employee’s duties. Apart from that, no other documents were found that would indicate that she was commissioned to perform any tasks during the period in question.

The notification emphasized that the former minister was employed in a task-based work time system, but she appeared at the headquarters sporadically. During these visits, her role was also not obvious.

There is also no evidence of completed tasks in email correspondence. “The content of the correspondence indicates that the emails concerned personnel matters, matters related to official equipment, participation in events, meetings, including holiday meetings,” it was written. No information indicating activities related to consulting for the management board was found.

The new management of Totalizator Sportowy also wrote about the possibility of a conflict of interest. In addition to her advisory role, Dmowska-Andrzejuk was also the president of SuperLiga SA (from November 5, 2021 to September 1, 2023).

In February 2022, the entities signed a letter of intent expressing their willingness to cooperate in the organization of the professional tennis league LOTTO Superliga by the Superliga. Totalizator Sportowy is the owner of the LOTTO brand. The parties expressed their willingness for the cooperation to last at least from 2022 to 2025.

“On April 28, 2022, an agreement was concluded for the provision of advertising services during the LOTTO Superliga tennis games in the following seasons: 2022, 2023, 2024. The gross value of the agreement is PLN 5,353,000. In the Company’s opinion, this raises serious doubts as to the lack of a conflict of interest on the part of Danuta Dmowska-Andrzejuk, while the management board of Totalizator Sportowy is fully aware of the functions performed by this person,” it was noted in a letter to the prosecutor’s office, which was obtained by WP.

The new management of Totalizator Sportowy assessed that the actions of the then president (2017-2024) Olgierd Cieślik, enabling the fictitious employment of Dmowska-Andrzejuk, were “inexpedient and apparent”. “(…) It should be assumed that her employment was aimed solely at satisfying her financial needs, without taking into account the employer’s interests,” it added.

The letter also indicated that such action had caused “significant property damage”, which, according to the notifying parties, constitutes a crime.

Dmowska-Andrzejuk and Cieślik react. Accusations “unfounded”

Former president Olgierd Cieślik considered the allegations to be “unfounded”. As he indicated in his response to the WP editorial office, the employment took place in accordance with procedures and legal regulations. Cieślik also denies that the aforementioned conflict of interest occurred. “I firmly deny that my actions were aimed at harming Totalizator Sportowy,” he said.

Danuta Dmowska-Andrzejuk stressed that her employment was “a fact, not fiction”. However, she refused to answer the questions asked, pointing to the confidentiality clause binding her.

Dmowska-Andrzejuk pointed to her sports achievements (epee fencer, two-time world and European champion) as well as her professional experience, emphasizing that they constitute “sufficient recommendation for acting as an advisor, especially in a company whose basic statutory tasks include investing in sports”.

Commenting on the cooperation between Totalizator Sportowy and Superliga, she pointed to the ongoing verification of all equivalents that formed the basis for mutual settlements.
