Daniel Noboapresident of Ecuador, decreed this April 30 the state of emergency in the provinces of Guayas, The rivers, Manabi, Gold y st. Helen within the framework of the persistence of the internal armed conflict, in accordance with a request from the Ministry of Defence.
The request from that State Portfolio was made based on article 8 of the Executive Order 218 on April 7, 2024. This paragraph reads like this:
«The Ministry of National Defense or the Ministry of the Interior may request the President of the Republic to declare a state of emergency in the event of requiring the suspension or limitation of the fundamental rights contemplated in the Constitution or exercising the exceptional powers authorized within the framework of the Constitution. Exception status”.
This emergency declaration will be valid for sixty days and is based “on the increase in hostilities and the need to carry out tactical combat operations against organized armed groups” in the aforementioned provinces.
In this context, the mobilization of the National Police and the Armed forces in accordance with article 3 of Executive Decree 218.
The following is established there:
- 1) Las Armed forces They must develop operations to prevent and eradicate the activities of organized armed groups in the national territory.
- 2) That the National Police and the Armed forces continue with the operational and tactical deployment required to neutralize armed attacks, threats or risks orchestrated by organized crime.
Furthermore, in these coastal provinces the right to domicile mobility is suspended. That is, the public force can carry out raids, inspections and searches in places where members of armed groups hide.
According to Ecuavisathe document of April 30 does not contemplate the curfew.
