Right-back Daniel Alves had his request for provisional release denied and will remain in prison while the investigation into an alleged sexual assault continues. The decision was confirmed on Tuesday by the Spanish court.
The Brazilian’s legal team filed an appeal on January 30 to have the former Barcelona player released from pre-trial detention after being arrested on January 20.
However, the judge in the case considered that Daniel Alves is at risk of fleeing due to his financial conditions and the fact that he has Brazilian nationality – Brazil does not have extradition agreements with Spain.
The 39-year-old winger is accused of sexually assaulting a woman in a nightclub in Barcelona on December 30th.
The investigation was launched in January, but it was only after the judge heard the statements of Alves and the young woman on January 20 that he was arrested.
To support the decision, the judge took into account the biological results performed on the alleged victim, the nightclub surveillance cameras, as well as the player’s contradictory statements.
Dani Alves, who denied any wrongdoing, returned to Spain from Mexico, where he played for Pumasalthough he terminated his contract with the club.
The investigation continues and no date has been set for a trial.
