Daniel (19) can still stay in the Netherlands: ‘Can cry with happiness’

Daniel Buter, who was born in the Netherlands, found out in 2016 that he did not have a valid passport. He was unable to enroll at MBO. Previously it had always gone unnoticed that he was actually illegal in the Netherlands.

He twice applied for a residence permit, but it was always refused. The Immigration and Naturalization Service (IND) suspected that Daniel also wanted to bring his father to the Netherlands with the new application. Both his parents do not live in the Netherlands.


He was arrested at the end of last year because he had not turned up for a ‘departure interview’.

So happy

But today finally came that long-awaited news: he can stay in the Netherlands. Daniel’s legal adviser, Maroua Bensalah, was told an hour ago.

“An IND employee called me to tell me the great news. Daniel is allowed to stay! I was very happy and immediately contacted him. He could cry with happiness.” I’m afraid I’m going to cry, “he said. He’s so happy. Especially now, in that horrible corona situation. He said: My nightmare is finally over now. “


Why can he stay now? “They are now convinced that he was really raised with his grandmother here in the Netherlands. He has Dutch nationality.”

Parents don’t come

His parents are not allowed to come to the Netherlands. The IND has previously determined that Daniel’s father may not live in the Netherlands. He had to leave the country in 2003, when Daniel was 3 years old.

Daniel’s mother had already left him as a baby. That is why it was decided to let Daniel grow up with his grandmother, who was allowed to stay in the Netherlands.
