On September 7, Tesla CEO filed a lawsuit against his girlfriend, “Grimes,” to gain access to his children, accusing her of moving to California to escape the laws of Texas courts. In files obtained by Insider, Musk said that he wanted to “create a parent-child relationship” with him. Their children are 3-year-old X, Exa (or Y) and 1-year-old Tao.
He said Grimes, whose real name is Claire Boucher, lived with him and their children from May to July this year, and also claimed she moved to California “in an apparent attempt to circumvent the jurisdiction” of the Texas courts.
Musk said, in filings, that he believed the custody dispute would be settled, but he wanted Texas courts to consider the matter if it did not. His case against Grimes was filed on September 13, and she filed her own lawsuit against Musk on September 29.
Grimes’ lawsuit seeks physical custody of the children and includes a “standard restraining order” that would prevent the children from being removed from the California home by either parent.
Musk stressed that revealing information about the case “would endanger the health, safety, or freedom” of himself, Grimes, and their children, and it would be difficult for an outsider to find this case. No children’s names were used, and Musk is identified only by his middle initial, “R,” and Grimes by her “E.” The hearing was originally scheduled for Friday, but was canceled after both parties agreed. Musk and Grimes’ controversial relationship
It’s just the latest rift over Musk’s children between Musk and Grimes, the musician with whom he has been in an on-again, off-again relationship since 2018, and Grimes’ two younger children with Musk have mostly avoided the spotlight.

Although the couple first separated in 2021, their relationship seemed amicable until recently, and Grimes continued to live with Musk in Austin for a period after their first separation, and last month, the singer seemed to refer to a legal problem with Musk.
