Derek Rosa García, the boy of Cuban origin who murdered his mother in the city of Hialeah on October 12will be tried as an adult by Miami-Dade County authorities.
According to the media Telemundo 51the decision to treat the 13-year-old boy as an adult in court was made during a hearing held this Friday, October 27.
With this, Derek Rosa could face a stricter punishment for the first degree murder charges hanging over him, with the state of Florida contemplating the possibility of life in prison without parole and even the death penalty for this crime.
This Friday’s hearing was attended by the child’s biological father, as well as his grandmother.
The father, a former military man identified as José Rosa, stated that his son was a good boy, honest and kind, so he cannot understand the reasons why he committed this atrocious crime.
Rosa assured that she raised her son with good values, and that Derek had aspirations of becoming an engineer for the army.
The young man’s father acknowledged that, although he raised him, his grandmother spent more time with him because they lived in separate homes. Likewise, he asked the authorities that his maternal grandmother move in with the minor, so that she could raise him as a productive member of society.
Kristen Reynoso, the minor’s attorney, requested that he remain held at the Juvenile Evaluation Center until the next hearing, stating that she trusted the United States justice system.
For now, the magistrate’s decision was to keep him at least without bail, so he will continue in custody at the Metro West detention center in Miami.
Murder of Irina García
News of the murder began to circulate on October 12, after authorities went to a home located at 211 West 79th Street in the city.
The officers arrived at the scene after the minor call 911 to confess what he had done. According to the disturbing call, the minor tried to take his life shortly after committing the murder, but he was unable to do so.
During the call, which lasted about 17 minutes, Derek claimed that he had stabbed the victim, Irina Garcia, while she was sleeping. To do this he used a knife that he found in the kitchen.
The minor’s mother had given birth two weeks before the incident, and when questioned about the condition of the newborn baby, the child stated that she was fine, and that nothing had been done to her.
Officers found the baby safe and sound in a crib next to the bed where the mother’s body was.
According to authorities, the boy also confessed to having taken photographs of his mother’s lifeless body, which he shared with some people on social networks.
