I think you should no longer see this as a driver or as a ‘car accident’. But simply a company where mistakes have killed people’s lives.

Subsequently, an investigation will have to take place to see what could have caused this to happen, and therefore also whether specific people are liable for this (e.g. sabotage), through negligence (poor maintenance/work or quality problems), or, for example, unforeseeable circumstances on the away.

To give an example:

A train that doesn’t try to stop for someone on the track because the driver isn’t paying attention. In addition, the driver can be blamed (unless, for example, it is proven that the driver was unable to work, which the person indicated, but the employer has exerted pressure with, for example, dismissal)
A train that tries to stop but can’t stop in time because the brakes are bad can be blamed on whoever is responsible for it, or on the company for refusing to replace them.
A train that tries to stop, but an underground explosion breaks the train off the rails and hits the person (I know, very unlikely, but oh well)
