“Crucial to correct inconsistencies in judicial reform”: BMA

The Mexican Bar Association (BMA) called on all political powers and authorities to resolve any conflict in strict accordance with the Constitution and the laws, to avoid a crisis that affects the rule of law, legal security and stability of the country.

The BMA recalled that district judges have granted various suspensions “to avoid irreparable damage” with the reform of the Judiciary, enacted on September 15.

In a statement, the association said that, however, some authorities have disregarded them, which violates the constitutional order.

“It is crucial that the reform of the Federal Judiciary be reviewed to correct inconsistencies within the constitutional text and with international treaties on human rights. In addition, this opportunity must be taken to include provisions that reinforce respect for the judicial career and regulate the powers of the new Judicial Disciplinary Court”.

He pointed out that in that sense, it is not advisable to promulgate secondary laws until the above is reviewed, to “avoid incurring irregularities” that could generate additional challenges, as well as violations of international treaties.

He added that the Amparo Law “offers clear mechanisms to resolve these controversies, and no authority has the power to ignore the suspensions granted.”
