Crox, killed by two peers: first request for a shortened sentence but with psychiatric evaluation – Pescara

PESCARA. No more immediate judgment (on February 12) for one of the two murderers of Christopher Thomas Lucianithe 16-year-old killed by two peers with 25 stab wounds on the afternoon of June 23rd in the Baden Powell park in via Raffaello for a debt of around 300 euros that the victim had for a drug issue with precisely those who today want to be judged quickly. The lawyers of the lawyer’s son, Massimo Galasso e Roberto Marianiyesterday morning they filed the request for an abbreviated procedure for their client at the juvenile court of L’Aquila: a request that automatically moves the proceedings before the preliminary hearing judge who will now have to set the date of the hearing. An almost obvious step given the evidence acquired during the prosecutor’s rapid investigation David Mancini and the substitute Angela D’Egidio who, for this very reason, had skipped the preliminary phase and requested immediate judgment.
PSYCHIATRIC EXPERTISE However, the lawyers have subordinated the alternative procedure (which provides for a reduction of one third of the sentence) to a psychiatric evaluation which could further reduce the quantification of the sentence. A request supported by a biased expert opinion which would highlight a rather delicate psychological situation of the accused, also in light of an alleged attempted suicide which occurred a couple of years ago, when the boy threw himself from the sea bridge (even though someone spoke of a tragic game). An abbreviated trial, however, is only possible due to the minor age of the accused, for whom, even in the presence of a charge of premeditated murder accompanied by a couple of heavy aggravating circumstances such as frivolous motives and cruelty, it does not provide for a life sentence. And it is only for this reason that it is possible to request this alternative rite. Going through a regular trial with a series of testimonies that were difficult to overcome would not have made sense from a procedural point of view. Not only that. What makes the accused’s position indefensible are two perhaps insurmountable obstacles. One concerns the results of the autopsy which, without a shadow of a doubt, state that the fatal blows were precisely those inflicted by the accused: ten stab wounds that hit the victim in the back, hitting him in vital points so as to cause his death. It is also true that that weapon (never found) passed into the hands of the co-defendant, son of a carabiniere, who without a direct reason, but only to please the “pack leader” (there were six of them that damned afternoon), continued that slaughter with another 15 stab wounds when Crox was dying on the ground, then kicked and spat on before leaving the scene of the crime to continue swimming in the afternoon at the seaside.
THE CONFESSION And the second defendant himself (who in the next few days should also request the same abbreviated procedure, assisted by lawyers Vincenzo Di Girolamo e Marco Di Giulio), who initially only declared that he had seen his friend stab Crox without having participated, in the final and decisive interrogation he confessed everything. Including the fact that he would have been the one to bring the knife and the gun stolen from his father who had it in the safe (a weapon which was also seen by other witnesses). A confession that makes the statements of the eyewitness, their friend, son of another policeman, who witnessed part of that murder even more credible.
THE AUTOPSY Poor Crox, also according to the results of the autopsy performed by the medical examiner Cristian D’Ovidio (in the presence of my colleague Along the lines of Polidoroexpert of the accused’s family), he didn’t even have time to defend himself given the speed and violence with which both the first one who hit him from behind, and the second stabber who intervened shortly after, attacked him, lured into that deadly trap with an appointment to which the pack leader showed up armed and with a change of clothes.
