The St.Gallen public prosecutor’s office has received several criminal charges against government councilor Stefan Kölliker. The reason: the mask requirement in upper school.
“I am hereby filing a complaint against Government Councilor Stefan Kölliker, in his function as head of the education department of the canton of St.Gallen,” begins the document that was leaked to stgallen24.
Franziska W. * and three other people have filed charges against government councilor and head of the education department, Stefan Kölliker. This is because, on behalf of the government, on November 2, 2020, Kölliker introduced compulsory masks for all students from the 1st upper level until further notice.
Prosecutor confirmed
The St.Gallen public prosecutor’s office confirmed to stgallen24 that four criminal charges had been received against government councilor Stefan Kölliker. All four are more or less identical in content.
«If a criminal complaint is filed against a member of the government, it is first forwarded to the Cantonal Council. This decides on the authorization of the public prosecutor’s office to open criminal proceedings against a member of the government », says Beatrice Giger, media officer of the St.Gallen public prosecutor’s office.
“Violate several ordinances”
According to the FW, the decision on the obligation to wear a mask, especially for schoolchildren, violated several higher-level ordinances and laws in the “most serious manner”. FW quotes the Federal Constitution in Art. 7-11: «Violation of human rights; special protection for children and young people. ” Or Art. 5 + 9: “Proportionality requirement and prohibition of arbitrariness” The Civil Code Art. 28 is also cited: “In principle, no sanction may be imposed without a law, which can already be found in the first article of the Criminal Code. Furthermore, the compulsion to cover the face fulfills the Act of coercion.»
On a third point, the “Risk of health damage » means, says W., that it has been proven that wearing a so-called respiratory mask can lead to various psychological and physical symptoms of illness. In doing so, she relies on a dissertation by a Dr. Ulrike Butz and a study by a Daniela Prousa, both from Germany.
“Schoolchildren in particular need to be able to perform well and be highly concentrated in order to keep pace in school. The fact that wearing a mask limits this performance has now also been scientifically proven, ”continues W.
Liability required
“The possible effects of a requirement to wear a mask for schoolchildren are classified as severe. I hereby expressly reserve the right to assert liability claims against the education department and the government council if my children have health problems which can be traced back to the current Covid-19 measures, ”the criminal complaint reads.
In conclusion, Franziska W writes: “The price we pay with the obligation to wear a mask, namely the damage to the mental and physical health of a large part of the population, is too great, especially since the effectiveness of the masks, which increases the spread of the SARS-CoV 2, has already been scientifically refuted several times. “
