COURT OF OSLO (Nettavisen): Wednesday 15 June, a security guard was supposed to check a guest at Wallmans in Oslo. It ended with an attack on the basket.

On Thursday, the case was heard in the Oslo district court, where the security guard was accused of acting as follows:

“Damaged another’s body or health, rendered another physically impotent or induced unconsciousness or a similar condition in another.”

He pleaded not guilty. And he has a very different explanation, which you can read further down in the case. The security guard, on her part, claims she was shot in the back, among other things.

Treated unfairly

The victim, a 27-year-old man, was a guest at an event at Wallmans in Oslo on the June evening in question.

He told the court that the security guard approached the table where he and some friends were sitting and said he “had to go out”. When the victim asked why, the security guard replied “you are creating a bad atmosphere”. At first, the victim tried to talk to the guard, but it is rumored that she was eventually persuaded by friends to go out with him.

The security guard was not interested in letting the 27-year-old wait for his friends, who were also about to leave the premises.

– I can’t understand that it wouldn’t have been easier for the security guard to wait just a few minutes before my friends and I had to leave. When it didn’t work, he could just put his hand on my shoulder and ask me to leave, the man said in court.

Basketball roof

The security guard and the victim then ended up in an argument near the entrance to the nightclub. It ended, according to the victim, with the guard grabbing him by the arm, and eventually the two ended up outside the premises.

– Then we end up on the ground outside the entrance and I feel a strong pressure on my neck and shoulders. The next thing I remember is I was sitting by a rock near the exit, then the police came. But I’m still in shock and I had close friends standing up and crying because they thought it went very wrong, the victim explained in court.

When the guard was about to take control of the guest who was lying on the ground, he sat on him so that the man lost consciousness. The guard put pressure on, among other things, his neck / neck, the victim says.

– I really have the impression that he is rather fed up with the power. He said “now you are under our roof, here we decide,” said the victim from the stand.

The 27-year-old admitted he drank a lot, but describes himself as “quite drunk, but in a good mood and maybe a little noisy”, and thinks he’s an “eight on the drunkenness scale” himself. At the same time, he admits he’s been kicked out of night clubs before, but never like this.

– Many times in the past I woke up the day after being kicked out and thought I should leave the club alone. I didn’t get that feeling the day after this incident, she says.

Totally disagree

The guardian, on the other hand, has a completely different story. However, both the defendant and the victim agree that it all started at the table where the victim was sitting.

– I was told by the restaurant manager that one guest was very drunk and half asleep in his chair. So I went to him and said “hey man, how are you?”, Quite routine. But he replies “go away, don’t touch me”, but a friend says to make sure you give him some air. Nothing is better, I thought, said the guard accused at the trial.

The guard said he then walked a bit in front of the offended 27-year-old, but when they approached the exit, the situation became tense.

– As we go down the stairs, I turn around and I see that behind me there are only offended people, and not the friend who should have let off steam with him. Then suddenly I feel a blow in my back. So I grab his arm in reaction, then a colleague arrives who is about to grab the other arm, but the colleague is then punched in the face.

He landed on the ground

After the blows, the offended man was led out where, according to the guard, he stumbled and fell to the ground. The guard then claims to have rested his knee on the victim’s lower back as he stood up to hear him being handcuffed.

The accused security guard and a colleague then picked him up and sat on a bench at the entrance. They checked him for his injuries and discovered what he describes as a cut on his forehead.

A short time later, the first police patrol arrived and began questioning witnesses. The security guard immediately reacted to the fact that he and his colleague were not immediately consulted by the police.

– The patrol said we were suspicious in the case and we should have beaten the victim. But we never beat. There’s a reason I have 15 years of experience as a Libra and still have an immaculate record. Eventually I got an e-mail that the case had been closed. Then one day the phone rings and someone tells me I’ve been charged with personal injury and not a violation, he says.

– Couldn’t you have pulled out when he was out? solicitor Julie Charlotte Aaheim asked.

– We can’t withdraw. We are responsible for the place and the guests. Going back inside and locking the door is an example of not doing your job, the guard says.

Aaheim tells Nettavisen they are filing a request for six months of unconditional imprisonment.

Defense attorney for the guard, Javeed Shah, responds to this statement by the prosecutor.

– I believe that the prosecutor could be bound by the practice of the Supreme Court, considering that the indictment was withdrawn by the prosecutor. In any case, I believe that jurisprudence and discretion dictate that you should have looked at the cause and the subsequent actions of the victim. She should have made a significantly lower claim, Shah writes, in an SMS to Nettavisen.

– Very sad

Wallmans Oslo CEO Cecilie Trøan Kjelsaas describes the whole thing as sad.

– It is very sad that he (the guard journ.anm.) Is where he is now. I have full confidence in our security company. It is important to underline that we are not a disco, but a restaurant with entertainment. He is not only responsible for looking after the guests, but also the artists, as well as preserving the liquor license, says Kjelsaas.

He points out that the guards are not Wallmans employees, but through a security company.

– Sometimes a lot of alcohol is consumed and things can happen. We have no such incidents against him and he has been fantastic for us in the five years he has been here. We wanted a permanent security team here and I personally asked for his services, he says.

Kjelsaas does not want to comment on the trial, and says she was not present at the evening in question. However, she saw the report.

– I receive all reports and find that things are handled in a polite and professional way. At the same time, we have more than 40,000 guests every year and things can happen, but I get all the reports and there aren’t many, she says.
