Freiburg (dpa) – In the new process surrounding the years of abuse of a boy from Staufen near Freiburg, the public prosecutor’s pleading called for preventive detention for the defendant. The court announced on Tuesday. The defense, however, sees the conditions for this measure not being met. The verdict is expected to fall next Tuesday.

A Spaniard has to answer before the court who was sentenced to ten years in prison in 2018 for serious rape of the boy, child abuse and forced prostitution. This penalty will not be called into question in the new trial. The point is whether preventive detention will be ordered against the man from the vicinity of Barcelona, ​​for which the presiding judge saw no basis at the time. The public prosecutor’s office successfully appealed against this decision to the Federal Court of Justice. Therefore, negotiations are now taking place again.

The courts do not impose preventive detention as a punishment, but as a preventive measure. It is intended to protect the population from perpetrators who have served their actual sentence for a particularly serious crime but are still considered dangerous. The crimes against the boy from Staufen became known in January 2018 and had caused horror nationwide. The mother and her boyfriend had raped the child for over two years and given it to other men from home and abroad for money for serious sexual violence. There were eight judgments in the case.
