President Andrés Manuel López Obrador sent this Wednesday, February 22, an initiative that proposes to reform the articles 513, 514, 515 from Federal Labor Lawwith the objective of updating and expanding the list of occupational diseases in Mexico.
For this reason, it is expected that in the ordinary session, on Thursday, February 23, the Chamber of Deputies will present and refer the proposal of the Chief Executive to the commissions for analysis.
In accordance with the initiative of the President of the Republic, it seeks to incorporate 115 types of diseases, which would go from 409 to 524 in the table for disabilities permanent occupational hazards.
The proposal also states that the table for occupational diseases, as well as the table for the assessment of permanent disabilities resulting from work risks, will be reviewed at least every five years or when there are studies that justify it.
Given this, the President will be the one to initiate the legislative process to update the tables, whenever required.
What diseases does AMLO want to include in the Labor Law?
According to the initiative of President López Obrador, the following conditions related to the workplace such as COVID, HIV, work stress and types of cancer are added:
- Mental disorders: anxiety disorder, nonorganic sleep-wake cycle disorder, stress-associated disorder, and depressive disorder.
- diseases like pneumoconiosis and bronchopulmonary produced by inhalation of dust, fumes of animal, vegetable, mineral origin, as well as those of the respiratory tract derived from the inhalation of gases and vapors.
- Infectious and parasitic pathologieswhich increase from 21 to 41, among which COVID-19 stands out.
- Diseases produced by ionizing and electromagnetic radiation.
- The disease group with the greatest increase is work-related cancer, going from four to 30 types.
- Diseases derived from poisoningwhich go from 36 to 46.
- Diseases endocrinological and genitourinary that help protect women in the prevention of repetitive abortions, infertility and endometriosis.
- causative agents (physical, chemical, biological, ergonomic and psychosocial) that give rise to the condition.
