In the case of the Europa business center parking lot, the Vilnius City District Court acknowledged that the multi-storey car park was unsafe and ordered more than EUR 200,000 in damages from the builder Hanner’s successor, Prime Location Property Fund. The decision can still be appealed by both parties.

2019 the driver was in resuscitation due to serious injuries when the car moved and fell from the fifth floor.
“The court emphasized in the case that the responsibility of the building manager cannot be underestimated when the risk of endangering both pedestrians or drivers moving on the site and adjacent to the building is caused by deliberately not installing protective handrails. The court was especially critical of the defendant’s behavior when the signing of the act recognizing the building as fit for use required an obligation to install protective railings, but this was not done for 15 years, ”said Marius Barisevičius, a lawyer for the victim and a lawyer for Averus.
According to him, according to the project and the valid construction technical regulations, the parking lot had to be equipped with 1.2 m high protective barriers along all the floors and perimeter of the site, but this was not done. In total, almost one kilometer of barriers had to be installed. Since the fall, people and cars have been distinguished only by the decorative finish of the aluminum façade.
According to the data of the Real Estate Register Center, the owners of the car park are Hanner’s successor, AB Prime Location Property Fund, and UAB BH Europa.
Evaldas Klimas, a lawyer at Walless, representing the interests of Europe, emphasizes that the Vilnius City District Court has ruled in a civil case partially upholding the applicant’s claim for pecuniary and non-pecuniary damage and awarding damages to the defendant AB Prime Location Property Fund. However, the applicant’s claim against BH Europa was rejected.
