Court rules on congestion charge plan

A court rules that a lawsuit can go forward challenging Gov. Kathy Hochul’s decision to stop a traffic congestion toll plan for southern Manhattan.

In a hearing Friday, a lower court denied Governor Hochul’s motion to dismiss the charges.

The defendants now have until October 15 to respond to the lawsuit.

The plaintiffs argue that the Governor does not have the authority to cancel the plan and that if it is not implemented it undermines the state’s environmental goals.

Hochul decided to put an indefinite stop ahead of collecting the new toll for vehicles entering south of 60th Street in Manhattan.

The governor and the MTA are facing another similar lawsuit.

And this while the MTA continues to seek money to carry out development projects as part of its capital plan that would be financed with income from the new tax.
