Court: Raid in Hamburg “Pimmelgate” affair unlawful | NDR.de – News

The Hamburg district court has now ruled that the house search in connection with the “Pimmelgate” affair was illegal. A court spokesman confirmed this on Friday.

Interior Senator Andy Grote was insulted on Twitter as a “dick”. A short time later, in September 2021, police officers searched the home of the author, Marlon P. He was staying with his then-girlfriend at the time of the raid. At the beginning of June, she subsequently resisted the search of her apartment and lodged a complaint. The Hamburg district court agreed, confirming a report by the “Hamburger Abendblatt” on Friday.

Raid “inappropriate” according to court

Although there was initial suspicion and the hope of finding evidence, there was a lack of proportionality between the raid and the seriousness of the crime – and thus the interest of the state. The court also considered the circumstances surrounding the tweet. At the time, Marlon P. commented on a post by Interior Senator Andy Grote, in which the senator described those celebrating in the corona pandemic as “stupid”. A few months earlier, however, Grote himself had violated Corona requirements. The insult “dick” should therefore be classified at the lower end of the threshold of relevance. The regional court therefore calls the raid “inappropriate.” Last weekend it became known that the Hamburg public prosecutor’s office had already started the proceedings against the accused Marlon P. in March discontinued due to a lack of public interest in criminal prosecution.
