The Constitutional Court issued a ruling this Wednesday that ordered the Health Promotion Entities (EPS) guarantee access to comprehensive treatments for breast cancer patientsprioritizing the life and well-being of women.
The decision highlighted the importance of adopting a gender perspective in the care of this disease, ensuring that patients receive the medications, procedures and services necessary for their recovery.

The high court emphasized that breast cancer must be approached as a complex disease that requires a multidisciplinary and person-centered approach.
The sentence arises after the study of a guardianship filed by a woman who was denied an essential medication for her treatment, despite the medical prescription.
In his ruling, The Constitutional Court recalled that the right to health is fundamental and that the State has the obligation to guarantee access to quality health services.
Likewise, he highlighted that the lack of authorization from Invima for a medication cannot justify the denial of a treatment when there is scientific evidence that supports its effectiveness and when the patient’s life is at risk.

Judge Diana Fajardo Rivera, in her clarifying vote, stressed the need for state institutions and EPSs to work in a coordinated manner to guarantee access to innovative and effective treatments for breast cancer.
Besides, He called to strengthen research in this area and promote the training of health professionals specialized in oncology.
In addition, the Chamber urged Invima to review and evaluate the new combination scheme of the drug Pertuzumab, to determine its viability and update in accordance with current regulations.
