The court has decided to open a retrial for the case of the late composer Yun Sang-sang (1917-1995), who was imprisoned for his involvement in the ‘Dongbaeklim (East Berlin) case’.

According to the legal community on the 17th, the 5th Criminal Division of the Seoul High Court (Chief Seung-ryeol Seo, Seung-hoon Ahn, Moon-soo Choi) recently made a decision to initiate a retrial on Mr. Yoon’s alleged violation of the National Security Law.

In a retrial decision, the judge said, “The act of arresting and detaining Isang Yun in the form of voluntary accompanying by a lie is an illegal arrest and confinement, and this is a reason for a retrial in cases where a prosecutor or judicial police officer has committed a duty-related crime.” .

The Dongbaekrim Incident is an incident in which the Central Intelligence Agency (currently the National Intelligence Service) announced in 1967 that about 200 people, including students and Koreans in Europe, visited the North Korean embassy in East Berlin and engaged in espionage activities. Yoon, who was active in Germany at the time, was transferred to South Korea and sentenced to 10 years in prison. At the time, the court found him innocent of the espionage charge and guilty of violating the National Security Law. He was later released after serving two years in prison thanks to the international rescue campaign and the help of the German government.

In 2006, the National Intelligence Service’s Development Committee through Truth Investigation of Past Cases announced that the Park Chung-hee regime had expanded and exaggerated the case into a large-scale espionage case for political purposes. As a result of the investigation at the time, on June 17, 1967, the Central Intelligence Agency staff dispatched to Germany lured Mr. Yoon to the Korean embassy by lying, “Let’s meet to deliver the president’s personal letter.” After being interrogated for two nights and three days at the embassy, ​​Yoon was repatriated to Korea and immediately detained by the Central Intelligence Agency.

Attorney Kim Pil-seong, the legal representative of the bereaved family, said on Facebook that day, “I applied for a retrial three years ago, but my family is elderly and the peace of life is important, so I did not disclose the fact of the application.”
