A player lost more than 70,000 euros while gambling online. The Frankfurt am Main regional court awarded him this sum back in a lawsuit against the online casino provider for violating the State Treaty on Gambling.
The sums involved in consumer protection proceedings against operators of online casinos and other online gambling services are becoming ever higher. Between 2017 and 2020, a player lost around 72,500 euros through online gambling. On September 29, 2023, the Frankfurt am Main Regional Court decided that the injured consumer has a right to a refund of this amount. The reason for this is that the online casino violated the State Treaty on Gambling with its offer and therefore had no legal claim to the funds received.
This follows the familiar pattern. The State Treaty on Gambling (GlüStV) regulates the extent to which online gambling may be offered. Only since July 1, 2021, online gambling providers have been able to legally present their offerings in Germany if they have a national license to do so. This results in a clear legal situation. Anyone who has lost money with an online gambling provider before this deadline can definitely claim it back.
“The objectives of the State Treaty on Gambling also include strengthening player protection in Germany, creating alternatives to illegal gambling, ensuring that legal gambling is carried out properly and preventing the development of gambling addiction. Therefore, the courts regularly side with injured players in order to implement this protective function of the State Treaty on Gambling,” emphasizes Mönchengladbach lawyer Dr. Gerrit W.
