A federal district court in Boston, Massachusetts, ruled in favor of a group of immigrants who in 2022 were flown from Texas to the exclusive island of Martha’s Vineyard. The operation was planned and contracted by the state of Florida by order of the governor, Republican Ron DeSantis, a harsh and defiant critic of President Joe Biden’s immigration policy.
The 77-page ruling allows immigrants and their lawyers to sue private companies responsible for helping state actors in what they consider a violation of the rights of vulnerable immigrants through illegal and fraudulent schemes.
In the ruling, the arguments against all other defendants in the operation were dismissed by the court. But the ruling clarifies that “the dismissal is ‘without prejudice,’ meaning the claims can be reaffirmed and reinstated at any time.
The lawsuit was filed by the group of affected migrants that receives support from the so-called Alianza Américas, a coalition of 53 immigrant-led organizations fighting for equitable policies in 18 states, and Lawyers for Civil Rights (LCR for its acronym in English).
The lawsuit was filed against the governor of Florida and the state of Florida for the “fraudulent” transfer of migrants and asylum seekers, all within an electoral context. DeSantis at the time planned to run for the Republican Party presidential nomination.
The airplane company
According to the lawsuit, the federal court in Boston allowed LCR attorneys and pro bono attorneys who defend immigrants affected by the transfer “to immediately proceed with legal claims against the airline, Vertol Systems.”
Vertol was hired by the State of Florida to carry out flights for immigrants that the federal government had allowed to enter the country once they had passed the first phase of an asylum process. In turn, he referred their cases to an immigration court so that a judge could resolve their futures in the United States.
