The Council of State will rule on Wednesday about the measure taken by the cabinet to postpone the reunification between recognized refugees and their family members. The highest court thus renders a final judgment on this so-called family reunification restriction.
In August, the cabinet decided that family members of these status holders may only come to the Netherlands once a home has been found for them. If no home had been found after fifteen months, family members were still allowed to come. With this, the cabinet canceled the previous policy, which allowed family members of a status holder to come to the Netherlands immediately.
Several status holders went to court because they now have to wait even longer for reunification with their loved ones. The judges all ruled that the restriction on family reunification is illegal and in violation of many national and international agreements.
State Secretary Eric van der Burg (Asylum) asked the Council of State for a final judgment on the family reunification measure. The measure was temporarily suspended until this ruling.
