François Sauvadet, President of the Departmental Council of Côte-d’Or, welcomed the decision of the Administrative Court of Appeal of Lyon, which rejected the request filed by the national federation of the League against road violence aimed at cancel the departmental decrees taken to authorize a return to 90 km / h on certain departmental roads. “This judgment reinforces the Department’s strategy, which intends to increase the speed to 90 km / h on the roads as soon as the road safety criteria are met” reacted the President.
The national federation of the League against road violence had already seized in March 2020 the Administrative Court of Dijon to annul 45 orders of President Sauvadet regulating the speed on sections of departmental roads. The court then rejected the Federation’s request, on the grounds that the latter did not have, in view of its statutes, the capacity to request the annulment of the decrees in question and indicating, in essence, to the wrong target. Like many of his counterparts, President Sauvadet had indeed seized the opportunity given to him with the promulgation of the mobility orientation law of December 2019 providing that Departments may derogate from the 80 km rule. / h on departmental roads under their jurisdiction.
The Dijon Administrative Court therefore found no fault with the decisions taken by the Department of Côte-d’Or, for which the issue of road safety is a priority, essentially inviting the Federation to attack the law of December 2019. , and therefore the State, rather than the departmental collectivity which only applies the said law. The appeal proceedings, with the ad hoc Administrative Court in Lyon, produced the same effects: the federation’s request was again rejected.
“I regret that the national federation of the League against road violence is locking itself in its position, refusing to recognize that road safety takes precedence over all our decisions in terms of road development. As proof, in February 2020 I created a Departmental Road Safety Observatory, a new tool to supplement existing systems and to have transparent monitoring of accidents on departmental roads, outside urban areas, ”continues the Chairman.
This observatory makes it possible to objectively monitor and analyze accidents on departmental roads, to assess the impact of returning to 90 km / h on the roads concerned and to adjust, if necessary, the policy carried out in terms of prevention and control. road safety. In March 2021, the Department presented an accident report on departmental roads which has fallen sharply for several years, particularly in terms of mortality. Each death is one drama too many, but we note that, for several years, the number of deaths on departmental roads has fallen sharply in Côte-d’Or.
The President of the Department will maintain the efforts of the community to ensure that the downward trend continues: “This year, the Department is investing € 32.7 million on its departmental roads to facilitate and secure the journeys of the Côte-d’Oriens. Safety is everyone’s business, on condition that we all work together on the real issues, in particular that of user behavior on the roads ”.
