Corona and vaccine: – Unvaccinated father lost the right of access

A Canadian father who does not want to be vaccinated against covid-19 has temporarily lost the right to see his twelve-year-old son.

BBC writes that a judge has ruled that it is not in the child’s “best interest” to visit the father.

The verdict was handed down at the end of December after the father had submitted a request for extended visiting hours during holidays.

The child’s mother opposed this, and thus carried it to Quebec Superior Court.

Discovered in social media

In the decision, which you can read in full here, it says that the child’s mother brought several transcripts with her during the hearing.

The transcripts were from the man’s social media, where he had written several posts against vaccines.

The child’s mother now lives with another man, as well as two other children who are too young to be vaccinated.

In court, it was revealed that she was afraid that the children would be infected.

The child’s father admitted that he has not been vaccinated against covid-19.

– He acknowledges that he has reservations about the vaccine, it says in the decision.

Will increase taxes for the unvaccinated

The infection has exploded in Quebec, and the province has the highest number of covid-related deaths in all of Canada.

Earlier this week, the authorities announced that they may increase the tax for unvaccinated residents.

According to the BBC, around 12 percent of Quebec’s population is unvaccinated, and the unvaccinated take up a quarter of the province’s hospital beds.

On Saturday, a large demonstration was held in Quebec against what many believe is the authorities’ lack of action against the growing infection.

Not good enough

The court decision states that the 12-year-old has been vaccinated, and thus has some protection against the virus.

– Is this enough for him to be with his father? The tribunal believes that this is not the case. There is in fact legal knowledge that the protection is not total, and that it may be reduced in the face of the omicron variant that is currently spreading in Quebec, it says.

The judge’s decision is valid until the beginning of February 2022, when the meeting will be reconsidered.

The decision states that the decision can be reconsidered if the man can be vaccinated.

– Normally it would be in the child’s best interest to have contact with the father, but it is not in his best interest to have contact with him if he is not vaccinated and opposes health measures, the judge stated in court.

An expert in family law tells the Canadian newspaper The duty that this is the first time that a parent has lost the right of access as a result of a lack of vaccination.

The father of the child has not commented on the decision to Canadian media.
