Coordinating Minister Agrees to Revise Law on Military Justice Amidst Bribery Case at Basarnas

Coordinating Minister for Politics, Law and Security Mahfud MD agreed with the proposed revision of Law Number 31 of 1997 concerning Military Justice. The suggestion to revise the Law on Military Justice arose after a polemic over the handling of the alleged bribery case that ensnared the Chief Basarnas Air Marshal Henri Alfiandi and Head of Basarnas Coordinator Lt. Col. Adm. Afri Budi Cahyanto.

“I agree that it needs to be discussed immediately,” said Mahfud at the Vice President’s Office, Jakarta, Wednesday (2/8).

Mahfud emphasized that he would consider the proposed revision of the Law on Military Justice. According to him, currently the revision of the Law on Military Justice is already on the list of the DPR RI’s long-term national legislation program (prolegnas).

“Yes, we will schedule it later, it’s already in the National Legislation Program. It’s in the Long-Term Prolegnas. Later we can talk about when the priorities will be included,” he said.

Meanwhile, Mahfud said that the handling of the alleged bribery case involving Henri Alfiandi and Afri is now more appropriate at the military court. This is because the Law on Military Justice is still in effect today.

He also believes that the TNI Military Police Center (Puspom) and the military court can objectively handle the case.

“I believe. In fact we coordinate one day directly [ditetapkan] suspects,” he said.

Elements of civil society proposed that the government and DPR immediately revise the Law on Military Justice after the alleged bribery case at Basarnas involving active TNI soldiers. The handling of the case, which was originally handled by the Corruption Eradication Commission (KPK), also caused uproar.

Puspom TNI did not accept it because the Corruption Eradication Committee carried out a hand-catching operation (OTT) and named suspects without coordination.

Chairul Huda, a criminal law expert from the Muhammadiyah University of Jakarta (UMJ), believes that the Basarnas corruption case should be a momentum for the Government and the DPR to revise the Law on Military Justice. He said efforts to revise the law have been going on since the beginning of reform, but so far have not been successful.

“Because the TNI has yet to agree on translating Article 65 paragraph (2) of Law Number 34 of 2004,” said Huda.
