Controversy Surrounding Court Decision on Detention of Migrants in Catania

All we needed was the approval of the Imam of Catania. The controversy surrounding the decision continues to rage Court of Catania: the judge did not validate the detention order for some migrants of the center of Pozzallo, unleashing the anger of the center-right which immediately returned to underlining the urgency of a justice reform. Defending the choice made by the judge who signed the provision is Abdelhafid Kheitwho without thinking twice sided with Iolanda Apostolico: in his opinion the judiciary “is a guarantee of protection of fundamental rights” and wanted to underline the fact that magistrates “play a fundamental role in the application of laws and in the defense of the rule of law”.

In this regard, contacted byAdnkronos, added that from his point of view the choice of the Court of Catania “to consider illegitimate” the government decree on accelerated expulsions “is part of this perspective”. L’Imam of Catania appealed to politicians, asking them to implement “realistic” laws and measures on the issue ofimmigration and to free ourselves from the logic of the emergency: “It is illegitimate to deprive asylum seekers of the right to enter Italian territory”.

Abdelhafid Kheit took advantage of the opportunity to list what in his opinion would be the winning recipe for dealing with the immigration issue. He cited international cooperation as an essential factor, focusing attention on integration programs “to promote social cohesion” and urging us to put down on paper solutions “that take into account human rights and the dignity of people”. Beyond the usual rhetoric, it would be curious to know how all this should translate into facts.

Obviously Abdelhafid Kheit’s doubts about the establishment of centers like the one in Pozzallo. But the government led by Giorgia Meloni has no intention of backing down, convinced that it is necessary to resort to a radical change compared to the past to put a stop to the continuous arrivals on the Italian coasts. The basic idea is clear: through the detention facilities for asylum seekers coming from safe countries it will be possible to verify whether or not the conditions for giving refugee status exist and, in the event of a negative outcome, proceed with theexpulsion in a short time.

It should also not be forgotten that the Ministry of the Interior intends to appeal the decision of the Court of Catania. A move which, if confirmed, would subject the validity of the legal references contained in the provision to the scrutiny of another judge. L’Ansa cited sources close to the migrant dossier according to which the accelerated border procedure is one of the aspects which, already contained in the 2013 European directive, “finds today the unanimous consensus of European countries in the context of the construction of a new Pact for migration and asylum and which the Italian government has regulated in the Cutro decree”.
