TEMPO.CO, Jakarta – Chairman of the Crescent Star Party, Yusril Ihza Mahendra, said his party could not confirm whether Gibran Rakabuming Raka will take the opportunity to become vice presidential candidate Prabowo Subianto after the Constitutional Court decision. Yusril also handed over to Gibran Rakabuming Raka to consult with his family, namely President Joko Widodo or Jokowi.
“We surrender it completely to him,” said Yusril to journalists in the Menteng area, Central Jakarta, on Tuesday 17 October 2023.
Apart from that, according to Yusril, the Constitutional Court’s decision changed the political map drastically because it opened up opportunities for Gibran Rakabuming. This decision, said Yusril, was controversial and contained legal flaws in it. Therefore, he hopes that President Jokowi and Gibran Rakabuming Raka will take a wise stance.
“In the midst of possible widespread reactions to this controversial decision,” he said. Nevertheless, Yusril will still respect the Advanced Indonesia Coalition when Gibran Rakabuming is appointed as Prabowo Subianto’s vice presidential candidate. “I respect the coalition’s decision,” said Yusril.
The Constitutional Court’s decision on the material review of Election Law Number 7 of 2017 concerning the age limit for presidential and vice-presidential candidates with the addition of the phrase once served as regional head caused controversy. The reason is that this decision was not taken unanimously at the Constitutional Court and is thought to be a way to ensure that President Jokowi’s eldest son, Gibran Rakabuming Raka, can take part in the 2024 presidential election.

Political observer from Al Azhar University, Ujang Komarudin, already suspects that the Constitutional Court will grant the judicial review of the age limit for presidential and vice presidential candidates. Ujang saw a structured, systematic and massive design carried out by certain groups.
“Using the Constitutional Court to legalize Gibran as vice presidential candidate,” said Ujang to Tempo when contacted Monday evening, October 16 today.
The Constitutional Court (MK) granted the requirement that presidential and vice presidential candidates or presidential and vice presidential candidates be at least 40 years old or have experience as regional heads. The lawsuit with case number 90/PUU-XXI/2023 was filed by a Surakarta University student named Almas Tsaqibbirru.
The Constitutional Court judge partially granted the lawsuit. “To judge, partially grant the applicant’s request,” said Chief Constitutional Justice Anwar Usman when reading out his decision, Monday 16 October 2023.
Previously, it was said that the Mayor of Solo would be Prabowo Subianto’s vice presidential candidate. Because he was not yet 40 years old, Gibran could not advance formally. However, when the Constitutional Court decided on a material test with the addition of the phrase above, Gibran was allowed to contest in the 2024 presidential election.
According to Ujang, this condition is a tragedy of democracy that is not good. MK, said Ujang, did not act as a statesman because of his decision to leave Jokowi and Gibran as vice presidential candidates.
“It’s been conceded,” he said.
In fact, according to Ujang, MK judges must act as statesmen so that their decisions are for the nation and state, not Jokowi’s family. He saw this phenomenon as a high-level political game that had been read about for a long time.
“Legal instruments can be controlled by power,” said Ujang.
