Contracts between ANI and the Colombian Society of Engineers would have irregularities • La Nación

The Attorney General’s Office warns that apparently there were disciplinary violations in the execution of the contract to evaluate the underground design of the First Line of the Metro.

Likewise, the control entity warned of the risks to public assets due to the estimate of the budget of contract VE-629-2023, since its value reaches $8,375,000,000, almost six times the value of contracts entered into by the ANI with similar objects.

The Attorney General’s Office warned of risks in the management of the National Infrastructure Agency -ANI- due to the conclusion of the contract for the provision of professional services with the Colombian Society of Engineers.

The requests made by the control entity to the entity apparently evidenced an alleged violation of the principle of autonomy of territorial entities and the principle of autonomy of the will of the parties in state contracts, since the ANI does not have the power to evaluate projects in which it does not act as a contractor or as a contractor.

Likewise, the First Delegate Attorney’s Office for the Surveillance of the Public Function warns that the entity would have ignored the Public Procurement Statute when choosing the contractor without respecting the plurality of bidders, the competition of merits and the principle of transparency.

Given the facts, after evaluating the documents of the contracting process and the responses of the ANI, actions were observed that could lead to alleged irregularities, which were recorded in a report so that the control entity, through The disciplinary investigation determines the possible commission of disciplinary offenses and their respective sanctions.
