What trick do supermarkets use with promotional items?
Supermarkets and stores must exchange and accept back non-food items, even if they were on sale. If a retail outlet makes a note like “promotional goods cannot be returned or exchanged” or something similar, then it is acting contrary to current legislation.
Experts reported this “Consumer Rights Protection”. They noted: “the consumer has the right to exchange a non-food product of proper quality for a similar one from the seller from whom it was purchased” if the product does not satisfy him for a number of reasons.
These, in particular, are the shape and dimensions. And:
- fashion;
- color;
- size;
- other reasons why the product cannot be used for its intended purpose.
“Buyers make purchases despite the usual inscription “Promotional goods cannot be returned or exchanged.” However, it should be noted that such a mark is contrary to the norms of current legislation. The consumer has the right to exchange goods of good quality within 14 days, not counting the day of purchase, if a longer period has not been announced by the seller,” the message says.
It is emphasized that the exchange of goods of proper quality is carried out subject to a number of conditions. In particular, if it has not been used and its presentation, consumer properties, as well as:
- fillings;
- labels;
- a payment document issued to the consumer along with the goods sold.
However, experts note, the above does not apply to the list of goods that are not subject to exchange (return) on the grounds approved Resolution of the Cabinet of Ministers dated March 19, 1994 No. 172. Their list includes, among others:
- perfumes and cosmetics;
- feather and down products;
- soft children’s toys;
- toothbrushes;
- shaving machines, etc.
As OBOZ.UA reported, supermarkets and stores often carry out minor “frauds” with the cost of goods. They do this in order to get more money from Ukrainians. For this purpose, in particular, they specially set prices so as not to give all the change to customers.
