The bill provides for:in. consolidation of airport infrastructure operators within one capital group. The project is also intended to improve and accelerate airport, railway and accompanying investments in connection with CPK. The proposed regulations are also intended to streamline procurement processes nieruchomo¶ci for the needs of CPK. At the same time, it was ensured that in this matter a number of social demands regarding the conditions of purchase were taken into account.
The draft reads about extending the catalog of “public activities in the CPK project to include coordination activities in the area of regional development, modifying the existing legal solutions in this respect”. In addition, “the project takes into account a number of social demands in the area of real estate, including the first solutions in the national legal order for the processes of organized relocation of towns”.
Changes in the rules of expropriation. The government will offer bonuses
Meanwhile, as we wrote in Next.gazeta.pl, in mid-July, the deputy minister of infrastructure and government plenipotentiary for the CPK, Marcin Horała, announced a reform of the rules of compensation for expropriation for public purpose investments. He explained that in accordance with the applicable rules, the basis for calculating the compensation is the estimated value of the property, which does not include the costs incurred in connection with moving or relocating a business.
The proposed changes presented by Deputy Minister of Infrastructure Marcin Horała consists in paying 10 percent. a bonus for each owner of an expropriated property and 20 percent. a bonus for owners of residential and commercial premises.
The reform would also provide for the granting of two additional privileges: the possibility of a civil claim for reimbursement of actual damage if a person suffers greater damage as a result of expropriation, and the possibility of obtaining up to 100 percent. compensation where compensation does not cover the cost of the removal.
