Constitutional Court Rejects Lawsuit to Change STNK and Vehicle License Plate Validity Period

The lawsuit against the Law on Traffic and Roads (LLAJ) was not accepted by the Constitutional Court (MK). Arifin Purwanto asked that STNK and vehicle license plates be changed from 5 years to lifelong.

“Declaring the Petitioner’s petition cannot be accepted,” said Chief Justice of the Constitutional Court Anwar Usman in a hearing open to the public at the Constitutional Court Building, Jalan Medan Merdeka Barat, Thursday (15/6/2023).

According to the Constitutional Court, all of Arifin Purwanto’s petitum formulations are unclear or at least not in accordance with the prevalence of petitums in cases of judicial review. This petitum has been reconfirmed to Arifin Purwanto during the Preliminary Examination session with the agenda of the Petition Correction Examination on May 25, 2023 and Arifin Purwanto remains in his position.



“Therefore, formally, such petitum is not in accordance with the petitum formulation as referred to in Article 10 paragraph (2) letter d PMK 2/2021,” he said.

Due to the ambiguity of the petitum or at least the Petitioner’s petitum is unusual, it causes the Petitioner’s petition to be unclear or unclear (obscure).

“Thus, the Petitioner’s application does not meet the formal requirements for the application as referred to in Article 31 paragraph (1) of the Constitutional Court Law and Article 10 paragraph (2) PMK 2/2021. Therefore, the Court does not consider the Petitioner’s request further,” he said.

The Constitutional Court considered that Arifin Purwanto did not clearly describe the constitutional problems he faced in relation to the enactment of the norms of Article 70 paragraph (2) of Law 22/2009.

“The Petitioner only described the concrete problems he experienced with regard to the process, the technical form of the STNKB and TNKB, as well as their validity period, so that the Court could not judge whether or not there was a problem of the constitutionality of the norm being petitioned for review,” he concluded.

As is known, the experience of advocate Arifin Purwanto dealing with tax for the Supra X 125 motorbike at the Madiun Samsat, East Java. At that time, advocate Arifin Purwanto’s favorite motorbike expired. Advocate Arifin Purwanto must pay taxes and arrange new license plates in Madiun, according to the origin of the motorbike. In fact, the motorcycle is in Surabaya.

“If the STNKB and TNKB are valid forever, like before Indonesia’s independence until 1964, then applicants certainly don’t need to bother bringing motorbikes from Surabaya to Madiun,” said advocate Arifin Purwanto.
