With eight votes in favor, the Plenary of the Constitutional court (CC) issued a judgment whereby it provides that within a month the Ministry of Public Health publish on the web portal the number from vaccines against him covid-19 who arrived in Ecuador in the “phase 0”And the distribution made by provinces.
The judgment of the CC was approved in an ordinary session that took place on December 1, 2021.
The Court reviewed two actions of Access to public information presented on January 25 of this year by the Ombudsman’s Office against the Ministry of Health, in which information is requested on the number of vaccines, the list of immunized people and the vaccination protocol. In addition, it resolved that the information must be delivered because it is considered public.
In its opinion the Court declared the infringement al right al Access to public information of all people for not providing the information requested by the Ombudsman’s Office.
It also confirmed the sentence of March 17, 2021 issued by the Provincial Court of Chimborazo; it revoked and annulled the judgment of April 14 issued by the Provincial Court of Tungurahua; Finally, the CC confirmed the judgment of the Ambato Judicial Unit of February 26, 2021.
In the fourth point of the sentence, the Court orders the delivery to the Ombudsman’s Office, by means of an official letter addressed to the highest authority of the institution and the same that must be published on the MSP website, within a period of one month, of the following information from the provinces of Chimborazo and Tungurahua:
1.– The number of vaccines that arrived in Ecuador in the so-called “phase 0” and the distribution made by provinces.
2.- List of people who have received the vaccine in the so-called “phase 0”, indicating their names and surnames, age, if they belong to health personnel and if they are an older person, without it being necessary to provide the number of citizenship card of vaccinated people.
3.- The vaccination protocol used for the inoculation of the vaccine in the so-called “phase 0”.
The Court also requests that once the term for the delivery from information the Ministry of Public Health and the Ombudsman’s Office inform the CC about compliance with the sentence.
