Constitutional Court maintains suspension against the Semilla Movement

The Constitutional Court rejected an appeal presented by the Movimiento Semilla party, due to errors detected in the procedure. This appeal sought to annul the party’s suspension order issued by Judge Fredy Orellana.

According to the magistrates’ resolution, the Semilla Movement’s allegation was not addressed. After the analysis, it was determined that the party did not present all the challenges established by law before requesting protection.

On July 19, Judge Fredy Orellana had rejected an appeal for reconsideration presented by Semilla with the intention of annulling the suspension order. However, instead of filing an appeal against this decision, the party resorted directly to amparo, omitting an appeal.

Due to this, the Court instructed the Second Chamber of Appeals to, instead of rejecting the protection, suspend it, given that the requirements set out in the law for the challenge were not met.

Despite this situation, the Semilla Movement can still oppose the decision. However, the suspension issued by Orellana on July 12 remains in place, since, so far, no legal appeal has been filed to annul it.

It is important to mention that this suspension, already executed by the Citizen Registry, will come into force once the electoral process is concluded. That is, after October 31, as determined by the Supreme Electoral Tribunal in its latest resolution.
