He constitutional Court has endorsed the vaccination against Covid-19 of a woman of Gran Canaria who suffers from senile dementia and a chronic organic psychosis that prevent her from deciding for herself if she wants the health dose to be administered. Her daughter expressed her refusal to adopt this measure and denounced that it could aggravate the health problems suffered by her mother. However, the ruling dismisses the family’s appeal by ruling that “the dangers to women’s health derived from contagion are, in principle, greater than those inherent to vaccination”.

The complainant maintained that her mother was very physically weak, that she did not leave the house and that the only contact she had was with her family. After being informed by “people who know about the subject,” the woman assured that it was not advisable to get vaccinated under these physical and health conditions. Likewise, she reported that They were trying to “impose” a “forced vaccination” on his mother when “vaccination in Spain is strictly voluntary”.
The report prepared by the forensic doctor from the Las Palmas Institute of Legal Medicine accredits the “mild cognitive impairment” of the person involved derived from her senile dementia, which “limits her from fully consenting to this health issue.” Nonetheless, The woman told the doctor that “she wouldn’t mind getting vaccinated” and that “if it has to be done, it will be done.”as stated in the sentence.
Risk of contagion
The Court takes into account that the affected person “goes abroad on occasion” to go to the hairdresser, receives family visits and lives with her two children, who carry out work and have contact with third parties, which poses a risk of contagion for them and their mother.
It also confirms that the vaccine is the Pfizer-BioNTech, which is the inoculation that is recommended for people in your age group and it has authorization from the European Medicines Agency “as it is demonstrated that the benefits of the medicine outweigh any risks.”
