Constitutional Court Dismisses 2024 Presidential Election Lawsuit by Anies-Muhaimin – CNN Indonesia

Constitutional Court (MK) dismissing the General Election Results Dispute (PHPU) lawsuit. 2024 presidential election which was previously confirmed by the Indonesian General Election Commission (KPU).

Decision No. 1/PHPU.PRES-XXII/2024 regarding the case petitioned by Petitioner No. 1 Anies Baswedan-Muhaimin Iskandar (AMIN) was read by Chief Justice Suhartoyo of the Constitutional Court at the Constitutional Court Building -legislative, Central Jakarta, Monday (21). /4).

“In the main petition, the petition of the petitioner is rejected in its entirety,” said Suhartoyo reading the verdict.

In addition, Suhartoyo said that the Court also dismissed the objections of the respondent and related parties in their entirety.

Suhartoyo said that there were different opinions (dissenting opinion) of the three constitutional judges in this case. Three constitutional judges dissenting opinion they are Saldi Isra, Arief Hidayat, and Enny Nurbaningsih.

Next, the Constitutional Court will read the lawsuit against the results of the 2024 presidential election filed by the candidate couple number 3 Ganjar Pranowo-Mahfud MD. The case is registered under number 2/PHPU.PRES-XXII/2024.

Both cases were heard and decided by eight of the nine constitutional judges. The eight judges are Suhartoyo, Saldi Isra, Arief Hidayat, Enny Nurbaningsih, Daniel Yusmic P Foekh, Guntur Hamzah, Ridwan Mansyur, and Arsul Sani.

Anwar Usman was not involved in the trial process because it was previously announced that he violated ethics in the decision of the case that changed the position of the presidential and vice-presidential candidates who passed Gibran.

Before that, Anies-Muhaimin challenged the results of the 2024 presidential election confirmed by the KPU. The demands of these two camps are similar.

One of their requests is to ask the Constitutional Court to cancel the results of the General Election Commission (KPU) vote count regarding the presidential election scheduled for March 20, 2024.

In addition, they also want the Constitutional Court to declare presidential candidate and vice-presidential candidate number 2 Prabowo Subianto and Gibran Rakabuming Raka disqualified as participants in the election of the president.

The Constitutional Court has held a hearing on the 2024 presidential election dispute from Wednesday (27/3). The Constitutional Court has requested information from the applicant, the respondent (KPU), Bawaslu, and related parties (Prabowo-Gibran). The Constitutional Court has also listened to statements from witnesses and experts presented by all parties.

In dealing with these two issues, MK has received dozens friend of the court proposed by various parties, including PDIP Chairman General Megawati Soekarnoputri.

It was recorded that 48 amicus curiae were filed in this case as of Friday (19/4). This number is the largest number in the history of the Constitutional Court handling PPU cases.

However, only 14 were included in the judge’s discussion, as Friday (16/4) was the highest number received at 16.00 WIB.
