Constitutional Council Blocks Controversial Sick Leave Measure in Social Security Budget for 2024

The Sages blocked it. While, as part of the Social Security budget, the government wanted to allow an employer to appoint a doctor to cancel sick leave that it deemed abusive, the Constitutional Council censored this controversial measure on Thursday, December 21. However, changes are expected in terms of work stoppages in 2024, and they are not negligible for employees. A large measure has in fact been retained regarding teleconsultation.

Faced with the shortage of doctors in certain areas or the difficulty of having an appointment quickly, including in large cities, sick employees have turned more to teleconsultation in recent months, in particular thanks to the teleconsultation terminals installed in pharmacies. However, as pointed out West Franceit will no longer be possible in 2024 to benefit from long-term work leave after consulting a doctor online.

A measure intended to combat short and repeated work stoppages

The Constitutional Council has in fact ratified the measure which aims to limit to three days the validity of a work stoppage prescribed following a teleconsultation. If, however, the sick employee consulted his own treating doctor remotely, his leave will remain valid. Same thing if he manages to prove that he is unable to obtain a physical appointment to renew his arrest.
