Constitutional complaint against new emergency services law in Baden-Württemberg – S+K Publishing House for Emergency Medicine

The Björn Steiger Foundation is currently preparing a constitutional complaint against the new emergency services law in Baden-Württemberg before the Federal Constitutional Court in Karlsruhe. The state’s Ministry of the Interior has already responded to the announcement with a statement. In the foundation’s opinion, Baden-Württemberg is not adequately fulfilling its duty to protect the basic rights of its citizens, as the responsibilities and structures in emergency situations have not been fully clarified and continue to fail to meet international standards. The guidelines are incorrect and the organizational structures are completely outdated. In addition to emergency patients, those who suffer are also the employees in the emergency services, who are not given a legally secure framework for their professional practice and no future-oriented structure and development opportunities through the law.

The Baden-Württemberg Ministry of the Interior clearly rejects the criticism of the Steiger Foundation. The rescue services in Baden-Württemberg are very well positioned and there is no need to fear national or international comparison. The new rescue services law sets the course for a future-proof and even faster rescue service that is oriented towards the well-being of patients. Self-administration in particular has proven its worth.

The new regulation of the Baden-Württemberg Emergency Services Act was passed by the state parliament on July 17, 2024 and came into force on August 2. According to the Björn Steiger Foundation, the Association of Southwest German Emergency Doctors (AGSWN), the German Professional Association of Emergency Services (DBRD), the emergency doctor network HonMed eG and the IG Private Emergency Services Baden-Württemberg have also joined the constitutional complaint.
