A conflict over the renovation of a block of social housing in Marnixstraat in the center ended in the subdistrict court this month. The tenant wanted, among other things, more drastic improvements, but the judge ruled against the resident.
The resident rents a home on the first floor and also has a storage room on the fourth floor. Ymere wanted to replace several storage rooms with homes and make the current homes more sustainable through, among other things, insulating walls, new central heating combination boilers and mechanical ventilation. The housing association had been working on that plan since 2016.
Underfloor heating
The tenant said he did not agree with the renovation proposal. He did not want an extra home in the attic, wanted underfloor heating instead of a central heating boiler with radiators and he wanted a roof terrace with greenery. Ymere wanted the man to cooperate in the renovation and went to the subdistrict court.
According to the judge, Ymere’s interests take precedence over those of the tenant. The question remained whether he would be bothered by the new resident on the attic floor, who will have a one-room apartment there on the site of two storage rooms. The judge agrees the verdict in addition to the shortage of housing.
Despite the presence of a central heating boiler, sustainability will also still lead to a home with an energy label A or B. Minister Hugo de Jonge (Public Housing) announced in May that owners of monuments and apartments are not obliged to install a heat pump and underfloor heating would be much more expensive. “His wish to optimize sustainability is understandable, but does not make Ymere’s proposal unreasonable,” the judge writes in the sentence.
The resident must therefore cooperate with the work by, for example, allowing construction workers to enter. The judge does not consider forced eviction necessary, because the tenant has agreed to cooperate if the subdistrict court judge rules against him. The work will take about two years and during that time residents can stay in a so-called alternating home for the same rental amount.
