Complaint to investigate if there was manipulation | Controversy over the laptop kidnapped from former official Nadia Schujman

Lawyer Hernán Martínez, defender of Marcelo Sain, asked the Public Ministry to investigate the handling of a computer seized from the office of lawyer Nadia Schujman, at the Ministry of Security, in the “illegal raid” on November 26, which in the opening of the equipment, last Thursday, it was discovered that “it did not have any type of storage disk inside”. The criminal complaint was filed with the prosecutors themselves who are investigating Sain, Ezequiel Hernández and Mariela Jiménez, so now the Office of Judicial Management (OGJ) must circumvent the judge who will intervene in the case.

Martínez denounced what he called a “severe irregularity.” On Thursday, at 9:30, -he said- the expert opinion of the “kidnapped elements” was carried out at the Ministry of Security, on November 26. The “opening act” of the electronic devices took place in the “Department of Forensic Digital Analysis, dependent on the Investigation Agency, Rosario headquarters.”

“When analyzing the elements that were the object of the act, it is clearly noted that they were not properly preserved. They did not have a security belt, the chain of custody was clearly violated, and even in many cases there is no identity between the prosecutor’s order and the characteristics of the elements.

“The third item of the prosecutor’s order mentions a Motorola model G7 Power cell phone, while the record shows an XT-1955-4 model.”

“The sixth item of the tax order indicates a Motorola model XT1926-6 cell phone, while the record refers to a G6 Plus model.”

“The really serious fact is that the Dell Inspiron 3493 model computer, serial number 16J8G13, did not have any type of storage disk inside.

According to the characteristics of the raid carried out on November 26, in which all those present were held incommunicado and the entry and/or entry of people was prohibited, it is physically impossible for someone to have disarmed the computer, removed the storage disk, reassembled and just there, deliver it for kidnapping, “says the complaint.

“Nor can one think of an extraction prior to the raid, since without a storage disk the computer cannot function. According to the respective label, the device would have been seized in the office of Dr. Nadia Schujman. “It wouldn’t make any sense to bring a computer that doesn’t work to the office.

“The only logical option in this scenario is that after the -illegal- hijacking of the machine, someone disarmed it and removed the storage disk. In addition to constituting a serious offense, the fact is demonstrative of the improper manipulation of which they have been subject to the seized items”.

Consequently, Sain’s lawyer requested that “the irregularity denounced urgently be investigated, giving an account of the whereabouts of the storage disk that corresponds to the kidnapped computer.”

After Martínez formalized the criminal complaint, the MPA denied the facts: “All the devices, material and documentation legally seized in the framework of that investigation are correctly preserved. In that sense, the chain of custody was respected,” he said.

“All the procedures ordered were carried out with prior notification to the parties involved in the process and were carried out with the corresponding control of the defense attorneys and/or technical delegates of the persons investigated. The same thing happened with the expertise that emerged in the last hours, which, in addition, was filmed and photographed while it was being finalized. The filming of the act shows the presence of the storage device in the corresponding place of the examined computer”.

The minutes of Thursday’s expert report reveal that the notebook in Schujman’s office “does not have any type of storage disk inside.” And at the bottom they sign: the police officer Leonel Gómez who disarmed the computer, the lawyer Hernán Martínez and the expert witness Leonardo Gianzone, who assists in Schujman’s defense.
