“I hate that. I don’t want to get in the way of people who want to go to work.” However, the woman dismissed her complaint against a penalty notice for formal reasons.
Four climate stickers from the “Last Generation” group had no chance with their complaints before the Administrative Court of Upper Austria on Wednesday. A “technical” error was decisive for the judicial failure.
The subject of the hearing was the appeals of the four activists who received administrative fines from the police for violating the Assembly Law and the Security Police Law. On November 21 and 28, 2022, the activists met on Hauptstrasse and Hafenstrasse in Linz
stuck. This programmed both traffic jams in the morning traffic and police operations.
Speaking of operations: After the protests of the “last generation”, the Vienna State Police Department recently announced the costs at APA’s request. The actions in January and February resulted in personnel costs of 475,242 euros for the executive. But back to Linz:
The climate stickers were obliged to pay fines by means of penal orders. A total of 450 euros should be paid per head. The “press” has an example of such a decree.
As a result, the activists only fought against the height of the penalties and were successful in doing so, the penalties were reduced. They did not fight the punishments as such.
Therefore, this has become final and the complaint should be dismissed, the court has now decided. “We are aware of the importance of climate protection,” emphasized one judge, but in this case one was not allowed to decide on the merits.
Fight for clean drinking water
“I don’t do it for fun or because I want to harm anyone,” said one of the complainants.
Rather: “I hate this. I don’t want to get in people’s way,
who want to work,” but she sees no alternative. “These
Government just does nothing. I am so afraid.”
“Our democracy, the preservation of social peace and our rule of law are important to me. There can be no social peace on a planet without clean drinking water and without enough food for all people,” said a member of the group, David Sonnenbaum (35), in advance announced. Therefore he sees himself forced to continue to offer peaceful resistance.
