The SPD Dietzenbach wants to check whether a loan to the municipal utility has run lawfully and has therefore lodged a technical complaint against Mayor Rogg.
The SPD parliamentary group has filed a technical complaint against Dietzenbach’s mayor Jürgen Rogg (independent). It is about 4.5 million euros, which the mayor is said to have withdrawn from the district town’s investment fund in 2019 in order to make it available to Dietzenbacher Stadtwerke as a short-term loan due to a liquidity bottleneck.
“This withdrawal and the subsequent loan were granted without a resolution by a local political committee,” says the SPD, which has sent the complaint to Brigitte Lindscheid (Greens) and District Administrator Oliver Quilling (CDU). There is a suspicion that Rogg violated his official duties with his actions. According to Section 266 of the Criminal Code, the SPD speculates that this could even be a case of breach of trust, so that the specialist supervisor must take action. She asks for “regulatory clarification and, if necessary, disciplinary measures”.
The mayor, who is also chairman of the supervisory board of Stadtwerke GmbH, sees the complaint from the supervisory board as “very relaxed”. “It’s an election campaign,” he says. Both the municipal utilities supervisory board and then the magistrate approved the 4.5 million loan at their meetings. However, the magistrate did not have a quorum at first, so the decision was taken two weeks later. The millions had already flowed in after the supervisory board resolution. “The same people who decided on the flow of money in the supervisory board also have a majority in the magistrate,” says Rogg.
At the last city council meeting, the SPD called for a file inspection committee, which has not yet been set up. That must be done “promptly”, so the mayor, there is no deadline here.
